Will the real Rick Ross please stand up? Yesterday, a press release was sent out that theex-drug lord is set to file a lawsuit against the rapper bearing the same name. The plaintiff was released from prison in 2009 after serving 15 years. He recently spoke to XXL on the reasoning behind the suit.
“I just want my name back. I don’t want to have to be ‘the real Rick Ross.’ When I go places I have to explain to people that I am the real one because Def Jam has put him on TV and now people recognize him. It causes a conflict.It ain’t even really against William Roberts you know what I’m saying? It’s really against Def Jam because they making all this money off of my name and you know those guys didn’t even reach out and said hello to me since I been home.”

I’m an attorney in NJ and I’m going to tell you all that this lawsuit is a waste of time. Someone mentioned the M&M/Eminem analogy. You can sue someone for appropriating your likeness and infringing on your business goodwill when the same or similar name causes consumer confusion. For example a couple of years ago DJ Drama was almost sued by Drama (late nineties/early 2000 rapper from ATL) over the Drama portion of his name. His argument was they were both signed to Atlantic and it would cause consumer confusion. That’s not the case here. The Real Ross is not a rapper and some of the people who buy rap music have never heard of him. The argument that Def Jam made money off the name is bogus as well. Officer Ricky had some hit records on all his albums which is why he sold units, people didn’t but the CD because he was named Rick Ross. In terms of him saying Ross stole his life story how can he prove that in court? Every rapper fabricates their rhymes with drug kingpin lines. I feel for the attorneys who took this case because its on a contingency fee basis, meaning they don’t get paid unless the “Real ” Ross wins his case. Maybe Def Jam will settle but it will be for peanuts.
