Update: Shyne Still In Custody

This news is sad and upsetting.

Representatives for the rapper revealed to MTV News that the Brooklyn MC is being detained by U.S. Immigration and Customs Enforcement at an unspecified facility in Western New York State. Officials are determining whether or not to deport the rapper, who was born in Belize, a rep explained.

“Shyne is currently in federal custody while his future immigration status is determined,” the rep said in a message to MTV News. Shyne attorney Oscar Michelen emphasized to MTV News on Tuesday afternoon that Shyne has not been released, contrary to media reports. At press time, the status of Shyne’s release from prison remained unclear.

Update: Rumors are beginning to swirl that Shyne will be deported. Gov Paterson pardoned Slick Rick. Will he help Po?

    I went through this with a close friend a few years ago. He probably had immigration/deportation hearings while he was in jail, like my friend did. And as far as the govt is concerned, aggravated felonies are grounds for immediate deportation. Usually, when you are detained after release, they’re just trying to put the final touches on the deportation. So unless someone has deep pockets for his legal fees, sorry to say it but barring a miracle he’s probably on his way back to Belize.

    There needs to be some serious reform where immigration laws are concerned.

    As media folks, YN gave Shyne his first cover at XXL. Recently Shyne talked about that in XXL’s 12th anniv. issue. He was happy that he had that as an outlet to get his voice across.

    @ dumb dumb – You are correct. It absolutely is the way the system works and Shyne is being processed according to protocol. But it doesn’t mean its right.

    I’m not talking specifically about shyne or slick rick, by the way. However, in Shyne’s case, I’m sure his family was waiting for him to come home.

    The immigration courts make their decisions while a person is incarcerated and seldom notify family of the decision. Oftentimes families don’t find out what’s going on until the person they love is on a plane headed to where they were born (escorted by marshalls the whole way).

    Aggravated felonies could be as simple as shoplifting, depending on the monetary value of the crime. in other words, not all aggravated felons are violent offenders. My main concern is for non violent offenders, many of whom were just working class people that made a mistake – and only had a green card. They’ve paid for their crimes (whether real or falsely accused) and just want to get back to taking care of their families and living their lives.

    Many of them have wives, children and parents in the states, but were deported anyway. Most of them didn’t have the resources (like, say, def jam money in the case of slick rick) to fight the deportation. And lots of them are being sent to places where they don’t know the language, customs, or have any support system/family.

    The families they leave behind usually don’t have the ability or resources to get to their loved ones and/or move to another country. Everyone suffers, especially the children.

    If anything, I hope this opens people’s eyes to the need for family reconciliation, because this happens every single day and mostly to people of color.

    Mr. Leviy will be home if and when the US Government finishes with its case against him. Remember, being deported locks him away from the American Touring Market, he could release music if he wants, he can live in Caribbean, if he wants, he does not need any money, remember the boat load Def Jam gave him for that last album, I think that deal is over and Def Jam walked away with a loss, he is okay, he has a team of lawyers, educators, community people and family working on his behalf.

    The amount of attention he can give to gun crimes, crimes by youth and the overall development of communities at odds, at this juncture. will be an incredible help. Some people want him to just go through deportation to be released, others want him stay and fight, others want him moved closed to Brooklyn, but everyone is working on the same side

    As far as the Fed’s is concerned, they passed a law after 911 that states anyone foreign national that gets arrested here and does more than 5 years in jail, will be deported, and it was retroactive, meaning, it could of happened in 95, 85, or 75, with Slick Rick it was different he did the Tom Joyner Cruise and deported himself, so coming back to mainland and someone saying something, is the reason he had got held up, put pressure on David Paterson to give Mr. Leviy a fare shoot to do good by his community; New York and Hip Hop
