Jay Z On NY Governor Police Reform Plan

Change Gon’ Come.

On Wednesday, New York Governor Andrew Cuomo rolled out the 2015 Opportunity Agenda, a criminal justice reform plan to help improve the relationship with the police and citizens. Afterwards, Jay Z, who met with the Cuomo last month responded to the initiative.

“The criminal justice reform package proposed by Governor Cuomo today is a huge step forward in restoring fairness, protection, sensitivity and accountability for all under our justice system. I commend Governor Cuomo for his bold leadership in taking this issue head on at this critical time. This package presents comprehensive steps to protect and improve relations amongst all citizens. We cannot be divided, as every single human being matters. Together, we can move forward as a community, with mutual respect for each other and continue to make this great state stronger than ever before.”

    The Governor’s Proposal below is the most relevant to the problems of: 1) police brutality and 2) the non-prosecution of law enforcement officials’ excessive/unwarranted force against the public.

    Proposal #63: Restore trust between community and law
    enforcement

    Underlying the American dream of economic opportunity is a foundational belief and trust in our justice system. But that belief and trust has been questioned, presenting a problem in both and in reality. To restore trust and respect between community and law enforcement the Governor proposes a number of recommendations, which include the following:

    1. Create a statewide Reconciliation Commission to address police/community relations in affected neighborhoods.

    2. Recruit more minorities into law enforcement.

    3. Obtain and make publicly available race and ethnic data on summonses, misdemeanors, and other police actions statewide.

    4. Fund replacement vests, body cameras and bullet-proof glass for patrol cars in high crime areas.

    5. District Attorneys may issue a grand jury report or a letter of fact in police cases where an unarmed civilian dies and the case is not presented to the grand jury or the grand jury fails to indict.

    6. The Governor will appoint an Independent Monitor (a retired judge, for example) to review police cases where an unarmed civilian dies and the case is not presented to the grand jury, or the grand jury fails to indict. In those cases, the monitor can recommend
    to the Governor the appointment of a special prosecutor.

    7. The Independent Monitor will have access to police files and grand jury information, which will be protected.

          Its the furtherest it can go though. There is no plan that goes further then a reform in police practices to better the relationship between law enforcement and the people. That is the furtherest step that can be made from a policy standpoint and even though tension was high in NY at the end of 2014, thats the right time to put in this kinda reform.

Instead of having an Independent Monitor to review police files and grand jury information who can recommend the appointment of a special prosecutor, why not just appoint a special prosecutor that can act independent of the Governor’s office? That way, no elected politicians are involved in the process. What happens when there’s a governor in office who’s really sympathetic to police? And Independent Monitor’s recommendation isn’t worth shit.

            Because your talking in terms of isolated cases because prosecutors change. This is about reform across the board. The governor has no choice but to be sympathetic to the police no matter who the governor is but that doesn’t mean steps cant be made. With this reform package there is no further to go. It addresses the whole problem. Now will there be more issues in the future? Of course because human nature will also leave room for errors but when your talking about reforming police practices themselves? Thats addressing issues before they even make there way to court. NY is not a third world country. Improving the relationship between the cops and the people is actually possible in that city.

            How am I talking about an isolated case? And you didn’t really respond to what I proposed. Of course the governor is going to be sympathetic to police in some fashion. But you’re talking as though appointing a permanent special prosecutor is impossible. It really isn’t that difficult. All he has to do is take executive action or propose a bill (then the legislature would have to act). District attorneys work hand-in-hand with cops. They shouldn’t be expected to prosecute the people they work with on a daily basis. A permanent special prosecutor that’s immune from political influence/executive action (a bureaucrat instead of a politician) is the best we can do. I never said that improving relationship b/w police and the people is impossible. I think it is possible, and it’s necessary.

Ok well first a monitor thats independent of the police department was what people were asking for in the first place so now thats in play. Now your talking about a special prosecutor thats immune to the influence of police? Thats cool but that immunity only lasts so long. The nature of the job will involve that prosecutor having relationships and being influenced by people on the side of the court system. Now my comments are about the streets. Before you even get to court, something has got to happen in the streets between you and the law. Now there is no perfect plan but what there has to be interaction between the police and the people where in the high 90 percent neither the person or the cop gets injured on hurt. That is already the case for the most part so now people just trying to reform the police activity to get it as close to 99% as possible. Thats it. Once it gets to court there will always be room for mistake because if I’m a cop and I kill somebody in cold blood and I say oh he went for my gun? Chances are I’m not going to be charged with anything no matter what goes down. The object is improve the relationship between the police and the people to the point where if I’m a cop, I would think twice about shooting somebody in cold blood.

            Homie. Again. I’m not knocking anyone’s efforts to improve the relationship b/w law enforcement and police. I’m just saying as a general matter. An independent prosecutor whose sole job is to watch over law enforcement and other government officials should be put in place. Period.             What side of the court system are you even talking about? There’s no one to side with if you have an insular office that’s run independently of the governor’s influence, the public’s influence, or law enforcement’s influence. The only way the prosecutor should be able to be removed is because of misconduct. I won’t go into this ad nauseam, I think I’ve thoroughly stated my position.

            We agree on that. There’s needs to be better law enforcement practices. I totally agree. We need that on the front end so we don’t have issues on the back.

            To your other point, internal affairs divisions still work under the same bosses as the regular police, (chief, commissioner etc.) Also, internal affairs can’t bring a criminal action, only a prosecutor. Again, independent special prosecutor is the best option. I didn’t say perfect, but it’s the best option. And it’s better than an Independent Monitor who can only “recommend” a special prosecutor. You feel me?

If a cop gives his testimony to a special prosecutor, he’s still a cop on the side of his department. Could that prosecutor present his own information and do his own investigations? Of course but again my comments were not even about a special prosecutor. An independent monitor that can “recommend” a special prosecutor is what the people wanted though. Now its in play. There are too many cases and not enough “special” prosecutors so that “recommendation” needs to be decided carefully.
